Welcome to Pavika! These Terms and Conditions ("Terms") govern your use of our school and college management software, mobile applications, and related services (collectively, the "Services") provided by Pavika ("we," "our," or "us").

By accessing or using our Services, you agree to:

Be bound by these Terms and our Privacy Policy
Comply with all applicable laws and regulations
Use the Services only for lawful purposes
Provide accurate and complete information

If you do not agree with these Terms, please do not use our Services. Continued use of our Services constitutes acceptance of these Terms.

2. Definitions

For the purpose of these Terms:

"Service" / "Services"	Refers to Pavika's web dashboard, Android application, and all related features including attendance management, fee management, exam management, etc.
"User" / "You"	Any individual or entity that accesses or uses our Services, including institutes, administrators, teachers, students, and parents.
"Institute"	Schools, colleges, coaching centers, or educational institutions that subscribe to Pavika's Services.
"Subscription"	The paid plan chosen by an Institute to access premium features of our Services.
"Content"	Any data, text, images, documents, or other materials uploaded, stored, or transmitted through our Services.
"Account"	A registered user profile created to access Pavika's Services.

3. Our Services

Pavika provides a comprehensive institute management platform that includes:

Attendance Management

Track student and staff attendance with SMS alerts to parents

Fee Management
Collect fees, send reminders, generate receipts

Exam Management

Schedule exams, enter marks, generate marksheets

Android Application

Native app for students, teachers, and parents

ID Card Generation

Create professional ID cards for students & staff

Study Materials

Share notes, PDFs, videos with students

3.1 Service Availability

We strive to provide 99.9% uptime for our Services
Scheduled maintenance will be communicated in advance
We reserve the right to modify or discontinue features with prior notice
Service may be temporarily unavailable due to technical issues

4. User Accounts

4.1 Account Registration

To use our Services, institutes must register an account. You agree to:

Provide accurate, current, and complete information
Update your information to keep it accurate
Maintain the security of your account credentials
Notify us immediately of any unauthorized access
Be responsible for all activities under your account

4.2 Account Types

Full access to all features

Teacher

Class & attendance management

Student

View results & materials

Parent

Track child's progress

4.3 Account Security

You are responsible for:

Keeping your password confidential
Restricting access to your account
All activities that occur under your account

5. Subscriptions & Payments

5.1 Subscription Plans

We offer the following subscription plans:

5.2 Payment Terms

Subscriptions are billed monthly or annually in advance
All prices are in Indian Rupees (INR) and inclusive of applicable taxes
Payments can be made via UPI, Net Banking, Credit/Debit Cards
Failed payments may result in service suspension

5.3 Refund Policy

30-Day Money Back Guarantee

Full refund if cancelled within 30 days of first payment
No refunds for partial months after 30 days
Refunds processed within 7-10 business days
Setup fees are non-refundable

5.4 Free Trial

14-day free trial available for new institutes
No credit card required for trial
Full access to all features during trial
Data preserved if you subscribe after trial

6. Acceptable Use Policy

6.1 You Agree To:

Use Services only for lawful educational purposes

Maintain accurate student and staff records

Respect the privacy of all users

Comply with all applicable laws

6.2 You Agree NOT To:

Upload malicious software or viruses

Attempt to hack or breach security

Share account credentials with unauthorized parties

Use Services for spam or harassment

Reverse engineer or copy our software

Resell or redistribute our Services

Violation of these terms may result in immediate account suspension or termination without refund.

7. Intellectual Property

7.1 Our Property

The following are owned by Pavika and protected by intellectual property laws:

Pavika name, logo, and branding
Software code and architecture
Website design and content
Mobile application
Documentation and training materials

7.2 Your Content

You retain ownership of all content you upload, including:

Student and staff data
Study materials and documents
Photos and images
Institute information

7.3 License Grant

By using our Services, you grant us a limited license to:

Store and process your content to provide Services
Display your content to authorized users
Create backups for data protection

8. Data & Content

8.1 Your Data

You are responsible for:

Accuracy of data you upload
Obtaining necessary consents from students/parents
Backing up important data locally
Compliance with data protection laws

8.2 Data Export

You can export your data at any time in standard formats (Excel/CSV). Upon account termination, we provide 30 days to export your data.

8.3 Data Deletion

You can request data deletion at any time
Data will be permanently deleted within 30 days of request
Some data may be retained for legal compliance

9. Limitation of Liability

This section limits our legal liability to you.

9.1 Service Provided "As Is"

Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

Warranties of merchantability
Fitness for a particular purpose
Non-infringement
Uninterrupted or error-free service

9.2 Limitation

To the maximum extent permitted by law, Pavika shall not be liable for:

Any indirect, incidental, special, or consequential damages
Loss of profits, data, or business opportunities
Damages arising from unauthorized access to your data
Service interruptions or downtime

9.3 Maximum Liability

Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Termination

10.1 Termination by You

You may terminate your account at any time by:

Contacting us via email or phone
Submitting a termination request through the dashboard
Providing 30 days notice for subscription cancellation

10.2 Termination by Us

We may suspend or terminate your account if you:

Violate these Terms & Conditions
Fail to pay subscription fees
Engage in fraudulent or illegal activities
Misuse our Services or abuse other users

10.3 Effect of Termination

Pro-rated refund (if eligible)
Account access revoked

What Survives

Payment obligations
Limitation of liability

11. Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

11.2 Dispute Process

Informal Resolution: Contact us first to resolve any issues informally within 30 days
Mediation: If unresolved, parties agree to mediation before legal action
Jurisdiction: Courts of Mau, Uttar Pradesh, India shall have exclusive jurisdiction
